Apr 12 at 14:39 comment added x64 @MadHatter all that is written in your source is that in US third-party rights "depend on the wording", in UK "no third-party rights exist" and in EU "third-party rights do exist, and specific performance is available". With such a degree of clarity what is all about, I will rather stick to my original interpretation.

This LWN article explains in much more length (full disclosure: I wrote the article, but I did not give the talk on which it is based).
